Terms and Conditions

These terms apply to every purchase made through oxiinstruments.com and its checkout at checkout.oxiinstruments.com, and to your use of the website. By placing an order you accept them. They do not limit any rights you have as a consumer under the law of the country where you live; where these terms and your statutory rights differ, your statutory rights prevail.

1. Who you are buying from

Throughout these terms, "OXI", "we" and "us" mean this company. "You" means the person placing the order. A "consumer" is a natural person buying for purposes outside their trade, business or profession.
2. The website
We take care that product descriptions, specifications, images, prices and stock information are accurate, but errors can occur. If an error affects an order you have placed (for example a wrong price or an item that is not actually in stock), we will tell you as soon as we notice, and you can choose to confirm the corrected order or cancel it with a full refund. Images are for illustration; minor variations in colour or finish do not constitute a defect.
We may change the content of the website, and add or withdraw products, at any time. We aim to keep the site available but do not guarantee uninterrupted access.
Links to third-party websites are provided for convenience. We are not responsible for their content or practices.
3. Placing an order
Orders are placed through the online checkout, which runs on Shopify. The steps are: add products to the cart, enter shipping and payment details, review the order summary, and confirm by clicking the order button. You can correct input errors at any stage before confirming.
After you confirm, we send an automatic email acknowledging that we have received the order. The contract of sale is concluded when we send you the order confirmation email; where we ship before sending a separate confirmation, the shipping confirmation serves as acceptance. We may decline an order before that point, for example where a product is unavailable, where the price was displayed incorrectly, where payment cannot be verified, or where we suspect fraud or misuse; any amount already paid is refunded in full.
We normally process orders within two business days (Monday to Friday, excluding Spanish public holidays). If a delay arises we will inform you promptly. When your order ships you receive a shipping confirmation with tracking information.
Orders are for personal or business end use. We may limit quantities and refuse orders that appear to be for unauthorised resale.
The contract is concluded in English. We keep a copy of each order in our systems; you can access your order history through your customer account or by contacting us.
4. Pre-orders
Some products can be ordered before they are available. For pre-orders:
Payment is taken at the time of the order. The expected shipping date shown on the product page is our best estimate and may change due to manufacturing or component supply; we will keep you informed and you may cancel at any time before shipment for a full refund. Pre-orders ship in the order they were received. If your order contains both pre-order and in-stock items, the whole order ships together once the pre-order item is available; if you prefer the in-stock items sooner, contact us and we will split the order where possible.
Everything else in these terms applies to pre-orders in the same way.
5. Prices and taxes
Prices are shown in the currency selected for your country. For deliveries within the European Union, prices include VAT at the rate applicable in the country of delivery. For deliveries outside the EU, prices are shown without VAT; import duties, local VAT or sales tax and customs handling fees may be charged by the carrier or the authorities of the destination country and are your responsibility. We recommend checking with your local customs office before ordering.
Business customers established in an EU member state other than Spain can buy VAT-free under the reverse-charge mechanism by entering a valid VAT identification number at checkout. We verify the number against the EU VIES register; if it is invalid or cannot be verified, VAT is charged.
Shipping costs are shown at checkout before you confirm the order.
6. Payment
We accept the payment methods shown at checkout, which may include major credit and debit cards, PayPal, Shop Pay and other wallets depending on your country. Payment is processed by the payment provider you choose; we do not receive or store your full card details. The amount is charged when you place the order.
Currency conversion fees charged by your bank or card issuer are outside our control.
7. Delivery
We ship worldwide with DHL and other carriers. Delivery times shown at checkout are estimates from the date of shipment, not from the date of the order. Risk in the goods passes to you when you, or a person you designate (other than the carrier), take physical possession of them. If you are a consumer and the goods arrive damaged or the parcel is lost, contact us and we will resolve it with the carrier; you do not need to claim against the carrier yourself.
If a delivery is refused, or cannot be delivered because the address you gave was incorrect or the parcel was not collected, and it is returned to us, we will refund the price of the goods less the costs of the failed delivery and return, unless you were entitled to withdraw under section 9.
8. Discount and creator codes
A discount or creator code must be entered at checkout; it cannot be applied afterwards. One code per order unless stated otherwise. Codes cannot be combined with other promotions, cannot be exchanged for cash, and are valid only for the products and period stated. Creator codes exist to support the artists who share their work with our community; using a code obtained by scraping, sharing on coupon sites or other misuse may lead us to cancel the discount or the order.
9. Right of withdrawal (14 days)
If you are a consumer, you have the right to withdraw from the contract without giving any reason within 14 days from the day on which you, or a person you designate (other than the carrier), receive the goods. For an order delivered in several parcels, the period runs from receipt of the last parcel.
To withdraw, tell us by an unequivocal statement before the period expires: an email to support@oxiinstruments.com is enough. You may use the model form at the end of these terms but it is not obligatory. Then send the goods back to the address in section 1 within 14 days of telling us.
We refund all payments received from you, including the standard delivery cost (not the extra cost of any express option you chose), within 14 days of the day we are informed of your decision. We may withhold the refund until we have received the goods back or you have supplied proof of having sent them, whichever is earlier. The refund is made using the same payment method you used, unless you agree otherwise; it is free of charge for you.
You bear the direct cost of returning the goods. Please use a tracked service and pack the instrument in its original packaging where possible; we are not responsible for returns lost or damaged in transit.
You may examine the goods as you would in a shop to establish their nature, characteristics and functioning. You are liable for any diminished value resulting from handling beyond that, for example signs of use, missing accessories or damaged packaging; in that case we may deduct a corresponding amount from the refund.
If you cancel before the order has shipped, we refund the full amount, with no deduction.
10. Legal guarantee and commercial warranty
10.1 Consumers in the European Union: three-year legal guarantee
If you are a consumer and the goods are delivered in the EU, you have a legal guarantee of conformity of three years from delivery. This is the period set by Spanish law (Real Decreto Legislativo 1/2007, as amended) and we apply it to consumers in every EU member state, even where the national minimum is two years. If the goods do not conform to the contract, you are entitled, in this order and under the conditions of the law, to repair or replacement free of charge within a reasonable time and without significant inconvenience, and, if that is not possible or not done, to a price reduction or to terminate the contract with a full refund. For a lack of conformity that appears within two years of delivery it is presumed to have existed at delivery unless proven otherwise. Shipping for a valid guarantee claim within the EU is at our expense.
Spare parts and accessories to keep the product working are available for at least ten years from the date the product was last placed on the market.
10.2 Customers outside the EU: twelve-month commercial warranty
If you buy from outside the EU, or you buy as a business anywhere, we warrant the product against defects in materials and workmanship for twelve months from delivery. During that period we will repair or, at our option, replace a defective product free of charge. This warranty is in addition to, and does not limit, any statutory rights you have in your country.
10.3 What the guarantee and warranty do not cover
Damage caused by accident, drops, impact, liquid, battery leakage, or incorrect storage; damage from misuse, negligence, or use contrary to the manual, including connecting non-certified power supplies or equipment, wrong voltage, or power surges; physically damaged connectors, encoders, keys or displays; repair, modification or opening of the unit by anyone not authorised by OXI; units with a removed or altered serial number; normal wear, cosmetic ageing and periodic maintenance; interference or noise caused by improper grounding or third-party equipment; damage in shipping (which we handle with the carrier, see section 7); and products sold as ex-demo, refurbished or second-hand, which carry the warranty stated at the time of sale.
Repairs and replaced parts do not extend the original period. If you bought from a reseller, contact the reseller first; the reseller is responsible for the legal guarantee towards you, and we support them. If you own a second-hand unit that is still within the period, we ask you to cover shipping for any repair.
10.4 How to make a claim
Email support@oxiinstruments.com with the order number or proof of purchase, the serial number and a description of the problem. We will diagnose remotely where possible and, if needed, give you return instructions and a return authorisation. Do not ship a unit without one. Firmware updates, which we release from time to time, are provided to keep the instrument working as described; we recommend keeping your unit up to date.
11. Software and firmware
The firmware inside our instruments and any companion software we provide are licensed, not sold. You may use them with the instrument they came with. You may not copy, modify, reverse-engineer or redistribute them except as permitted by law. Third-party or open-source components are subject to their own licences, listed with the software.
12. Liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for breach of your statutory rights as a consumer, or for anything else that cannot be excluded by law.
Subject to that, we are liable for foreseeable loss caused by our breach of these terms or by our negligence, and we are not liable for loss that was not foreseeable when the contract was made, for loss caused by events outside our control (section 13), or, if you are a business, for indirect or consequential loss, loss of profit, revenue, data or business, and our total liability to a business is limited to the price paid for the order concerned.
13. Events outside our control
We are not liable for delay or failure caused by events beyond our reasonable control, such as component shortages, supplier failures, strikes, transport disruption, natural disasters, epidemics, war, government action or failure of communication networks. We will tell you if such an event affects your order and, if it lasts more than 30 days, you may cancel the affected order for a full refund.
14. Complaints and disputes
If something is wrong, write to support@oxiinstruments.com and we will do our best to resolve it. Consumers in Spain may also contact the consumer office (OMIC) of their municipality or the regional consumer authority, and consumers in other EU countries may contact their national consumer authority or European Consumer Centre. We are not bound to use alternative dispute resolution bodies but will consider a request in good faith.
These terms are governed by Spanish law. If you are a consumer, you also benefit from the mandatory provisions of the law of the country where you live, and you may bring proceedings in the courts of that country or in Spain. For businesses, the courts of Vigo (Pontevedra), Spain, have exclusive jurisdiction.
15. Changes to these terms
We may update these terms. The version in force when you place an order is the one that applies to that order; the version number and date at the top identify the current text. Changes do not affect orders already placed.
